Terms & Conditions
All orders are cash unless other terms have been previously approved. If credit terms have been established, orders will be invoiced as NET 30 from the date of invoice. A 2% monthly (24% annually) finance charge will be added to the unpaid balance. A minimum service charge of $5.00 will be charged on all past due accounts. Purchaser agrees, in the event of default, to pay all collection costs incurred by seller, including court costs and attorney fees. The charge for a returned check is $25.00
Return of Merchandise
If you have any issues with the products you receive from us, please contact us within 10 days after receipt of the merchandise. Please do not return any merchandise without prior permission. There will be no credit for product returned without a return authorization.
Returns of media products (such as Permacharts, books, and DVDs) are only accepted in the case of a defect.
Some products we carry are warranted by another manufacturer or other authorized agent. In these cases, we may refer you to another entity to process the warranty issue.
Once a product has been returned with an authorization, we will promptly inspect the product and if appropriate refund the original price paid.
All returned products need to have a return authorization and should be returned in the original condition within 30 days of the ship date. Products returned within 31 to 60 days will be charged 15% for restocking and there is no credit or replacement after 61 days.

EXCLUSION OF WARRANTY AND LIMITATION OF DAMAGES AND REMEDY
PLEASE NOTE: Growingmicrogreens.com warrants that the seed we sell conforms to the label description as required by State and Federal seed laws. Neither Growingmicrogreens.com nor the seller hereof (if other than Growingmicrogreens.com) MAKES ANY OTHER REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THE CONTENTS HEREOF, WHETHER AS TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER MATTER.
All Claims, including claims for alleged defective seed must be made within thirty (30) days after Buyer learns of the facts upon which such claim is based. All claims not made in writing and received by Growingmicrogreens.com within the time period specified above shall be deemed waived.
THE LIABILITY OF GROWINGMICROGREENS.COM AND THE SELLER HEREOF FOR ANY AND ALL LOSSES AND DAMAGES TO BUYER RESULTING FROM ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, BREACH OF WARRANTY, OR ALLEGED DEFECTIVE SEEDS, IRRESPECTIVE OF WHETHER SUCH DEFECTS ARE DISCOVERABLE OR LATENT, SHALL IN NO EVENT EXCEED THE PURCHASE PRICE OF THE PARTICULAR SEEDS WITH RESPECT TO WHICH LOSSES OR DAMAGES ARE CLAIMED. IN NO EVENT SHALL GROWINGMICROGREENS.COM OR THE SELLER BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS.
IT IS EXPRESSLY AGREED THAT THE REMEDY PROVIDED ABOVE SHALL BE TO THE EXCLUSION OF ALL OTHERS.
Should fulfillment of any order or contract be prevented or delayed by an act of God, war, blockade, revolution, government action to restrict energy or any other essential to the growing and harvesting of the crops, prohibition of exports or imports, riots, strikes, lockouts, fires and/or detention at sea or any other contingency beyond our control, we shall not be held responsible for any loss and/or damages thereby.
IF YOU DO NOT WISH TO ACCEPT THESE PRODUCTS UNDER THESE TERMS, PLEASE RETURN IMMEDIATELY FOR A FULL REFUND.

Other products and services may require different or supplemental information from you in order to apply.
Under no circumstances do we transfer your email address to any other company, nor do we collect any personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs.
You understand and agree that the owners of this site shall not be liable for any direct, indirect, incidental, consequential or exemplary damages, including but not limited to, damages for loss of profits, data or other intangible losses (even if the owners of this site have been advised of the possibility of such damages), resulting from the use or the inability to use the product(s) and or service(s) or any misuse of the product(s) and or service(s) in a manner not in accordance with their intended use.

All orders above $35 will recieve free shipping (Lower 48 States Only). Any purchase below $35 in the lower 48 states will be charged a flat rate of $5.95.
When shipping to Alaska, Hawaii, and Puerto Rico, additional fees may apply--unless you are able to fit the entirety of your order in one flat rate box.
Due to Canadian customs restrictions, we can only ship 1 pound of small seed crops per lot, or 10 pounds of large seeded crops.
Large seed crops include peas, beans, corn, and most grains like barley and wheat.
Small seeded crops include alfalfa, broccoli, radish, and onions.
One must also obtain a certificate of analysis issued by a ISTA seed lab. The Utah state seed lab (where we are located) and most other state labs are AOSA certified.

We have shipped seeds internationally and are happy to help you through the process.
In many countries, seeds are a regulated product and may require special documentation and/or permitting.
The most common requirements:
- A Phytosanitary Certificate – If you require a phytosanitary certificate we can work with our local office of the US Department of Agriculture (USDA) to obtain a certificate. The fee is $65 per shipment.
- An Import Permit – Some countries also require an import permit. You would need to provide this permit issued by the destination government.
There may be additional requirements or descriptions depending on the destination country and the crops being imported. We try to be aware of each country’s requirements but it is ultimately your responsibility to make sure you comply with the local regulations and have the appropriate paperwork.
